Terms of service

1. Acceptance of Terms

By accessing and using the TOLEDO HANDYMAN Service Portal (a service brand owned and operated by The Mindful Landlord LLC, herein referred to collectively as the "Company" or "TOLEDO HANDYMAN"), you accept and agree to be bound by these Terms and Conditions ("T&C"). If you do not agree to these terms, you must not use the Portal.

2. Definitions and Scope

  • TOLEDO HANDYMAN / Company: Refers to the service brand TOLEDO HANDYMAN, which is owned and operated by The Mindful Landlord LLC.

  • Portal: The online interface provided by the Company for submitting, viewing, and managing service requests.

  • Customer: A user who submits a service request (Job Request) through the Portal.

  • Job Request (Ticket): A formal service or repair request submitted through the Portal.

  • Service Fee: The payment for labor and trip charges.

  • Material Cost: The cost of all goods, parts, and supplies purchased for the job.

3. User Accounts and Service Request Submission

  • Accuracy: You warrant that all information provided is truthful, accurate, and complete.

  • Emergencies: DO NOT use this Portal for emergencies. For emergencies, immediately call 911 and then notify the Company at [Your Emergency Contact Number].

4. Financial Terms and Payment

This section governs the financial relationship between the Customer and TOLEDO HANDYMAN.

  • Service Fee Pre-Payment: Full payment for the estimated Service Fee (labor and trip charge) is required at the time of scheduling and must be processed before the Handyman's arrival at the property. Work will not commence until this pre-payment is received.

  • Material Cost Payment: Payment for all Material Costs purchased for the job is due immediately upon job completion. This payment is separate from the pre-paid Service Fee.

  • Material Estimation: Any estimate provided for Material Costs is provisional. The final Material Cost will be based on the actual retail price at the time of purchase. TOLEDO HANDYMAN will provide proof of purchase (receipts) for all materials used.

  • Taxes: All applicable federal, state, and local taxes (including sales tax) will be added to the final Service Fee and Material Cost payment.

  • Non-Payment: Failure to remit full payment for all Material Costs and any final balance within [e.g., 7] days of the invoice date constitutes a breach of contract and may result in the pursuit of legal action by The Mindful Landlord LLC, including a lawsuit, to recover the outstanding balance plus associated legal fees.

5. Scheduling and Execution

  • Arrival Time Changes: All quoted arrival times are estimates. The actual arrival time is subject to change due to unforseen circumstances, including but not limited to, traffic, prior job delays, or material sourcing issues. TOLEDO HANDYMAN will make reasonable efforts to notify the Customer of any significant changes.

  • Authorization: By submitting a Job Request, you authorize the Company and its assigned staff to enter the property at the scheduled time to perform the agreed-upon services.

6. Intellectual Property and Content Rights. By submitting Content (photos, videos, or other media files) through the Portal, you grant the Company and its agents a non-exclusive, royalty-free, worldwide license to use, store, display, and share this Content solely for the purpose of assessing, communicating, quoting, and completing the Job Request and for documenting the service provided. You warrant that you own or have the necessary rights and permissions to provide this Content to the Company for this purpose.

7. SMS and Electronic Communications. By providing your mobile number and explicitly checking the consent box within the Portal, you agree to receive service-related text messages (SMS) from TOLEDO HANDYMAN. These messages are strictly transactional and non-marketing, pertaining to the status of your Job Request (e.g., 'New', 'Assigned', 'Completed') and critical customer care matters (e.g., scheduling changes). Standard message and data rates may apply. You may reply STOP to any message to unsubscribe from further SMS notifications. Replying HELP will provide assistance. You also agree that all notices and agreements related to your account or the service may be provided to you electronically.

8. Limitation of Liability and Indemnification

  • Portal "As Is": The Portal is provided on an "as is" and "as available" basis.

  • Maximum Liability: In no event shall the total liability of TOLEDO HANDYMAN / The Mindful Landlord LLC for claims related to the use of the Portal (as opposed to the services performed) exceed $100 USD.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Ohio.
